Quick answer

In Maharashtra, an agreement relating to immovable property is stamped under the Maharashtra Stamp Act, 1958 and registered under the Registration Act, 1908. Agreements for sale of property carry stamp duty like a conveyance on market value and must be registered; development agreements are also charged on market value; leave and licence agreements carry 0.25% duty; agreements not specifically covered by the Act carry a small fixed duty. Registration fee is 1% of value, capped at ₹30,000, for most property agreements.

Which agreement do you need?

Booking a new flat from a builder in a RERA projectAgreement for Sale
Buying a flat in a building under the Apartment Ownership Act (condominium)Agreement to Apartment
Transferring a society flat, shop, gala or tenancy rightsAgreement to Transfer

Calling a document by the wrong name does not reduce stamp duty — the Collector of Stamps looks at what the document actually does. Choosing the right form at the start avoids penalties and re-registration later.

Documents required for agreement registration

How the agreement registration process works

  1. Tell us the deal

Share what is being bought, sold, transferred or let, and the agreed terms. We identify which agreement fits — the name matters for stamp duty.

  2. Title and document check

We review the title chain and approvals so the agreement does not bind you to a defective property.

  3. Draft

Agreement drafted with payment schedule, possession, default, cancellation and dispute clauses, and shared on WhatsApp for approval.

  4. Stamp duty and fee

We calculate duty under the correct article of the Stamp Act and generate the GRAS e-challan.

  5. Register

We book the Sub-Registrar slot; parties sign with two witnesses and receive the scanned document and Index-II.

Stamp duty on agreements in Maharashtra

  • Agreement to sale / agreement for sale — stamp duty as on a conveyance, on the higher of the agreed price and the Ready Reckoner value: about 7% in Pune, PCMC and Thane municipal limits, 6% in Mumbai (1% concession for women buyers). The later sale deed then needs only nominal duty if full duty was paid on the agreement.
  • Development agreement — duty on the market value of the property being developed.
  • Leave and licence — 0.25% of total rent plus notional interest on the deposit.
  • Lease — duty depends on the term; see lease deed.
  • Agreements not otherwise provided for (for example, a simple MOU without transfer of property) — small fixed duty.

Registration fee is 1% of the value, capped at ₹30,000, for most transfer-type agreements; ₹1,000 (urban) or ₹500 (rural) for leave and licence.

Why registration matters

Under Section 17 of the Registration Act, agreements for sale of immovable property relied on for part-performance must be registered, and an unregistered document that should have been registered cannot be used as evidence of the transaction. Banks will not disburse a home loan against an unregistered agreement, and MahaRERA complaints need the registered agreement. Registration also creates a public record (Index-II) that protects you if the seller tries to sell the same property again.

Frequently asked questions

Is registration of a property agreement compulsory in Maharashtra?

Yes for agreements for sale of immovable property, development agreements and all leave and licence agreements. They must be presented to the Sub-Registrar within four months of signing.

What is the stamp duty on an agreement in Maharashtra?

It depends on the type. Agreements for sale carry duty as on a conveyance (about 6–7% in city limits), development agreements are charged on market value, leave and licence agreements carry 0.25%, and agreements not otherwise provided for carry a small fixed duty.

Can you draft and register any type of agreement?

Yes. We draft and register agreement to sale, agreement for sale, agreement to transfer, agreement to assignment, apartment agreements, development agreements, lease and leave and licence agreements across Pune, Pimpri-Chinchwad, Mumbai, Thane and Palghar.

Can an agreement be registered at home?

Only leave and licence (rent) agreements can be registered online with doorstep Aadhaar biometrics. Sale, transfer, assignment and development agreements are signed at the Sub-Registrar office; we prepare everything and book the appointment.

What happens if an agreement is not registered?

It cannot be relied on as evidence of the transaction, banks will not lend against it, and stamp duty with penalty may be demanded later. The other party could also deal with the property in the meantime.

How long does agreement registration take?

Drafting takes 1–2 working days after documents are complete. Registration is done on the booked Sub-Registrar date and the scanned document is usually available the same day.
