A deed of apartment is the registered document that conveys a flat and its percentage of undivided interest in the land and common areas to the buyer, in a building submitted to the Maharashtra Apartment Ownership Act, 1970 by a registered declaration. It is executed by the developer or land owner in favour of the apartment owner. Where full stamp duty was paid on the registered agreement for sale, that duty is adjusted, so the balance is often nominal.
How the condominium route works
- The developer or land owner executes and registers a declaration submitting the land and building to the Apartment Ownership Act.
- Each buyer signs an agreement to apartment or agreement for sale.
- On completion, a deed of apartment is executed in favour of each buyer, conveying the flat and its share of the common areas.
- Apartment owners form an association to manage the building, in place of a co-operative society.
Because title passes to each owner directly, a separate society conveyance is not needed in this route.

When deeds of apartment are delayed
Many buyers in older condominium projects never received a deed of apartment, which causes trouble at resale or redevelopment. Owners can jointly ask the developer to execute deeds; where the developer is uncooperative, legal remedies are available. We review your documents and suggest the practical route.

Frequently asked questions
What is a deed of apartment?
It is the registered conveyance of a flat, with its share of the land and common areas, to the buyer in a building submitted under the Maharashtra Apartment Ownership Act, 1970.
Is stamp duty payable again on a deed of apartment?
If full duty was paid on the registered agreement for sale, it is adjusted, so the balance is often nominal. If the agreement was under-stamped, the difference is payable.
Who executes the deed of apartment?
The developer or land owner who made the declaration, in favour of each apartment owner. Both sign at the Sub-Registrar office.
What if my building has no declaration?
Then it is not under MAOA, and title to the land is usually transferred to a co-operative society by conveyance or deemed conveyance instead.
Do I need a deed of apartment to sell my flat?
It is strongly recommended. Buyers and banks prefer a complete title chain; without it, resale and loans can be delayed.
