A sale certificate is issued to the successful bidder when an auction sale by a bank under SARFAESI, a court, a Debt Recovery Tribunal or an IBC liquidator is confirmed. Courts have held that it is evidence of title, that it need not be compulsorily registered, and that the issuing authority sends a copy for filing under Section 89(4) of the Registration Act. Stamp duty becomes payable when the original certificate is presented for registration or used for another purpose. Many buyers still register it to simplify loans, mutation and resale.
Filing vs registering a sale certificate
Following the Supreme Court’s view that a sale certificate on confirmation of a court or authority auction is evidence of title, the Bombay High Court has held that stamp duty cannot be demanded merely for issuing a SARFAESI sale certificate, and that filing a copy under Section 89(4) of the Registration Act is enough. Duty arises when the purchaser presents the original for registration or uses it for another purpose.
In practice, registering the certificate gives you an Index-II, which many lenders, societies and future buyers ask for. We explain the cost of both routes for your property so you can decide.
