If the heirs notarize the document on stamp paper for ownership rights, will be considered as legally valid.

Mumbai: Milind Borikar, the Chief Officer of the Maharashtra Housing and Area Development Authority (MHADA) Mumbai Board, assured the residents of Motilal Nagar that if the legal heirs of a deceased owner notarize the document on stamp paper for ownership rights, it will be legally recognized. However, before taking possession of the houses, the concerned individuals must submit a legal heir certificate.
The redevelopment process of Motilal Nagar in Goregaon West has gained momentum after the court granted MHADA permission to appoint a developer. However, several challenges remain, prompting various tenant associations to take efforts to resolve them. Under the leadership of Shiv Sena leader and former minister Subhash Desai, residents submitted a memorandum of demands to Borikar. During the discussion, Borikar assured that no resident would be treated unfairly in the project.
Many residents of Motilal Nagar 1, 2, and 3 expressed their willingness to pay the transfer charges to MHADA for ownership rights. However, MHADA refused to accept the payment since the original owners, such as parents, had passed away. MHADA stated that it could not accept payments in the name of deceased individuals and required the heirs to obtain a legal heir certificate. When residents pointed out that obtaining a legal heir certificate is a costly and time-consuming process, Borikar acknowledged the concern. He clarified that while residents must clear outstanding dues, MHADA will recognize the ownership if all legal heirs of a deceased owner come together and submit a notarized document on stamp paper.
